2. Gallery

The gallery is located at Mikulandská 120/8, Prague 1 – Nové Město, 110 00.
The gallery’s regular opening hours are Monday to Friday from 10am to 6pm.

3. Area of activities

ArtKabinet Zíka spol. s r.o. is engaged in the purchase and sale of works of art (sculptures, glass, jewelry, art on paper, porcelain, clocks, and more).
The available items are exhibited in the gallery and also offered on this website, where they are accompanied by photographic documentation, a description, and their price. This website does not enable customer registration nor is it possible to use online payments to make payments or to purchase an item directly. In order to reserve an item, please call us, contact us via email, or use the reservation form on this website. The items’ prices are the final price for the buyer. When shipping an item, the price includes packaging costs.

4. Payments and delivery

Goods are released only after full payment. Payment may be performed

- in cash during personal pick-up
- via payment card during personal pick-up
- via bank transfer
- via PayPal

Upon mutual agreement, goods may be sent via Czech Post or another shipping company to an address in the Czech Republic or abroad, or also via cash-on-delivery within the Czech Republic. Transport costs are charged according to the price list of Czech Post or other shipping company.
The seller undertakes to ship the packaged goods within 10 working days from payment of the full purchase price. The final delivery deadline is always indicated in the order confirmation email. The price for the artwork does not include its installation. The buyer will receive a tax document (invoice) along with the shipment.

5. Viewing of goods

The items displayed on the website may be viewed in person upon prior agreement via email or telephone. We will gladly answer all your questions.

6. Returns and refunds

Goods must always be viewed and inspected during personal pick-up. The items on sale are used items. Wear and tear reflecting their age is not included in their description. In line with relevant legal regulations, ArtKabinet Zíka spol. s r.o. is not liable for defects corresponding to the item’s level of use or wear at the time of receipt by the buyer. When purchasing goods, the buyer acknowledges that the goods are sold on commission or directly by ArtKabinet Zíka spol. s r.o., that these are used goods for which no warranties apply, that the seller provides no warranties for these goods, and that the goods are not subject to the provisions of the civil code regarding defects in sold items.
If the buyer has purchased the artwork based on its presentation on the website and discovers a defect after delivery that was not included in the description, or if the text does not correspond to the item, then he or she is entitled to return the artwork. ArtKabinet Zíka is obligated to receive the returned work and to refund the purchase price without delay.


7. Informational duty as per Act on Registration of Sales

According to the Act on Registration of Sales, the seller is obligated to issue the buyer a receipt and must also record the received earnings immediately online with the tax administrator – in case of technical difficulties, no later than within 48 hours.

8. Information on the processing of personal data – GDPR

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, further only “GDPR”) and in line with the relevant Czech legal regulations, in particular Act no. 101/200 on the protection of personal data (further only “ZOOU”), in relation to the processing of your personal data by:

we hereby provide you with the below summary of basic information regarding the processing and protection of your personal data.

Purpose and extent of personal data processing:

The Company processes only personal data that it has acquired in line with GDPR, and collects and processes this data only for the established purpose, to the extent described below, and for the period of duration of this contractual relationship plus the subsequent three years following its conclusion. After this, the Company shall process your data only to an extent and for purposes that do not require your consent as per valid regulations.

We process data that you yourself provide, in particular data from forms filled out on our website, data provided when entering into a contractual relationship with us, or data provided with your consent if such consent is requested and given.

The Company acquires personal data only from you as the subject of this data, and does so within the context of concluding a contract and/or negotiations on concluding a contract and/or from forms filled out online, and this to the following extent: name, surname, title, home/business address, telephone and/or email contact (when filling out forms online), name, surname, title, home/business address, date of birth, birth number, sex, ID number (passport, ID card, residency permit, etc.), telephone and/or email contact, bank account number, proclamation as per Act no. 253/2008, proclamation as per Act no 69/2006 (when concluding a contract and/or during negotiations on concluding a contract and for financial transactions – i.e., payments, including relevant payment information).

The Company processes personal data both manually and automatically. The protection of personal data is ensured on both the technical and organizational side in accordance with legal regulations. The Company requires the same level of security from the processors of personal data with which it has concluded a processing contract, and provides sufficient guarantees for the protection of your personal data.

The Company hereby proclaims that, on the basis of legal requests, the personal data may be provided to third parties with the legal authority to demand the provision of said personal data. We will not provide your personal data to any other third parties, not even abroad.

Legal foundation for the processing of your personal data

The legal foundation that allows us to process your personal data depends on the purpose for which we process the given personal data. In this specific case, we are permitted to process your personal data because:

The right to the restriction of the processing of your personal data in the cases defined by Article 18 of the GDPR, in which you have the right to ask us to limit the processing of your personal data.

The right to the erasure of your personal data, especially if a) they are no longer needed for further processing, b) you have revoked your consent for their processing, c) you have justifiably objected to their processing; d) they were processed illegally; or e) they must be erased in accordance with legal regulations

The right to the portability of your personal data; under the conditions defined in Article 20 of the GDPR, you have the right to receive your personal data and to transfer them to a different administrator if this is technically feasible..

The right to object  to the processing of your personal data if we are processing them for the purposes of a) direct marketing or b) our own justified interests. If we are processing the personal data for our justified interests, you have the right to object to such processing and we will no longer process the data if our justified interest does not outweigh your interests or your rights and freedoms. If the justified interest is direct marketing, raising such an objection always means the end of further processing for the purposes of direct marketing.
