Auction rules

ArtKabinet Zíka spol. s ro, with its registered office in Prague 1, Mikulandská 120/8, ZIP code: 110 00, entered in the Commercial Register kept by the Municipal Court in Prague, Section C, File 30829, Company ID: 07827709, Tax ID: CZ07827709, hereinafter referred to as " ArtKabinet Zíka", mediates the sale of art objects by auction. Auctions are organized in accordance with international practices in the field of trade in art objects and the course is governed primarily by these auction rules and, in addition, in accordance with Act No. 250/2023 Coll. on public auctions.


Auction

An auction is understood as the manner in which ArtKabinet Zíka makes a public offer to the participants to purchase art objects, how the presentation of the auction participants takes place and how the auction is carried out up to the moment of the formation of the purchase contract, including the regulation of the rights and obligations of ArtKabinet Zíka as the seller and the participant as the buyer. The auction is governed by Act No. 250/2023 Coll. on public auctions .


Auction rules

A participant in the auction may be a natural or legal person who is duly registered with ArtKabinet Zíka and meets the legal requirements for legal capacity and whose legal actions cannot be opposed or who cannot dispose of their property due to a legal obstacle (e.g. insolvency proceedings).

The participant will register with ArtKabinet Zíka on the website Livebid.cz. The data provided by the participant during registration must be correct and truthful, and ArtKabinet Zíka has the right to such personal identification of the participant that is unique and cannot be confused with any other person.

The participant - a natural person, therefore, acknowledges by registering that, pursuant to Act No. 110/2019 Coll. on the Protection of Personal Data, ArtKabinet Zíka collects the participant's identification to the extent necessary for the proper exercise of the participant's rights and obligations and stores this data about him in electronic form on its server without providing it to anyone without a clear purpose necessary to achieve the exercise of the said rights and obligations or without handling it for the achievement of purposes by him or another person other than those related to the Auction Rules or the law.

A participant with access to online auctions has the right to place a bid or enter their highest bid (limit) at any time during the auction and not wait for the end of the auction.

If a limit is set, the system will automatically bid in favor of the participant who entered the limit amount, up to the predetermined amount, if possible. Since the auction process is based on alternating bidding by individual participants, it is possible that if a limit is set, the auction will end at the amount set by the limit or one bid lower.


An auction of an item takes place when participants place bids. The following are considered bids:

a) 100 CZK, if the immediate auction price is less than 5,000 CZK

b) 500 CZK, if the immediate auction price is at least 5,000 CZK but less than 10,000 CZK

c) 1000 CZK, if the immediate auction price is at least 10,000 CZK but less than 50,000 CZK

d) 2,000 CZK, if the immediate auction price is at least 50,000 CZK but less than 100,000 CZK

e) 5,000 CZK, if the immediate auction price is at least 100,000 CZK

The buyer (auctioneer) is charged a commission of 22% on the auctioned price.


Auction subject

The auction items are marked and described, including the starting price (lowest bid) on the LiveBid.cz website. Each work is documented with photographs.

All auction items are at the ArtKabinet Zíka gallery, Mikuladská 8, Prague 1, where they can be viewed 10 days before the auction.

ArtKabinet Zíka reserves the right to cancel the auction of an auctioned item or change its date due to a server outage, natural disaster, or other serious reason. Furthermore, ArtKabinet Zíka is not liable for connection problems on the auctioneer's side.


Payment terms

The offered item is sold to the highest bidder. The buyer (bidder) is charged an auction commission of 22% of the price achieved. The commission includes VAT.

The invoice is always sent to the bidders the day after the end of the auction, which is Friday, and the work can then be picked up after payment no earlier than the following week, starting on Monday, unless otherwise agreed.

The auctioneer acquires ownership of the art object acquired by him at auction upon full payment of its purchase price.

Payment for auctioned items must be made no later than 14 days after the end of the auction , using the following methods:

  • By transfer to the account of the ArtKabinet Zíka gallery held at ČSOB, account number 291305866/0300

IBAN: CZ52 0300 0000 0002 9130 5866 BIC: CEKOCZPP

  • In cash or by credit card (VISA, MASTER CARD, AMERICAN EXPRESS) at the ArtKabinet Zíka gallery, Mikulandská 8, Prague 1

  • By agreement, auctioned items can be sent cash on delivery.


In the event of a delay in payment of the purchase price by the auctioneer of more than 14 days, ArtKabinet Zíka is entitled to withdraw from the purchase contract formed in the auction.

Purchased items will be released immediately after payment and the buyer will receive a handover protocol and proof of ownership.

Storage of auctioned items is free of charge for 40 days from the date of the auction, after which a storage fee of 1% of the price of the work will be charged per day.

Bidders who do not comply with the terms of the auction rules will be blocked and subsequently excluded from the auction.


Postage and packaging costs to the Czech Republic when sending a package by hand:

  • Package up to 35 cm – 250 CZK

  • Package up to 50 cm – 300 CZK

  • Package over 50 cm 350 CZK

For more expensive shipments, the postage may be increased by additional package insurance.

Shipping costs abroad are handled individually.

All costs associated with transportation are borne by the auctioneer. ArtKabinet Zíka Gallery is not responsible for any damage incurred from the moment of acceptance of the auctioned items for transportation by the contracted carrier. Any complaints should be directed to the shipping company that delivered the work to the auctioneer at the moment of acceptance of the shipment.


Complaint

Before purchasing the items, the buyer acknowledges that the items are from an auction sale and that they are used items and that no warranties apply to them, the seller does not provide any warranties for these items and the provisions of the Civil Code on defects in the sold item do not apply to them.
If the buyer purchased the item based on the description in the catalog and after inspection or delivery found defects that were not listed in the description, or the text did not match the item, he is entitled to return the item. ArtKabinet Zíka is obliged to take over the item and immediately refund the purchase price.

ArtKabinet Zíka is not responsible for color deviations in the photographs shown on the website.

Upon receipt of the item, the buyer is obliged to check it and, in the event of damage not specified in the item description, to notify the buyer. This claim must be made in writing, the buyer must provide a description of the defect and what he is claiming. A later claim may not be taken into account.

ArtKabinet Zíka Gallery reserves 10 days to process a complaint.


Final provisions

Every interested party has the opportunity to view the items offered before the auction.

Damage corresponding to normal wear and tear of objects due to their age is not listed in the catalogue (e.g. worn gilding on porcelain and glass, scratched glass surfaces, minor restoration work, etc.). Damage that affects the artistic value of the object is listed and specified.

In case of uncertainty about the condition of the auction item, the participant may send an (e-mail) inquiry before bidding, otherwise it is assumed that the participant has no doubts about the condition of the auction item.

The participant acknowledges and agrees that the auctioned items may be subject to restrictions arising from legal regulations, in particular they may be declared (or proposed for declaration) as a cultural monument within the meaning of Act No. 20/1987 Coll., on state monument care, they may be subject to restrictions within the meaning of Act No. 71/1994 Coll., on the sale and export of objects of cultural value or similar restrictions. ArtKabinet Zíka does not guarantee that an export permit or other similar administrative act will be granted by the relevant administrative authority, which the auction participant acknowledges.

to the resolution of disputes between ArtKabinet Zíka and the buyer, and the Municipal Court in Prague shall have territorial and substantive jurisdiction.


These auction rules apply to auctions held from 1 January 2026.
